Terms of Sale — Obliquo Reality Desktop
This English version is provided for information only. If there is any discrepancy, the Spanish version prevails.
1. Seller
These terms govern the sale of Obliquo Reality Desktop licenses by:
- Voxel 3D, S.L.U., Spanish tax ID (NIF) B47735733.
- Registered office: Plaza de Marcos Fernández, 1, oficina 3, 47014 Valladolid (Spain).
- Registered in the Commercial Registry of Valladolid, volume 1476, folio 111, sheet VA-27191, 1st entry.
- Email: info@voxel3d.es. Phone: +34 983 02 41 78. Website: https://voxel3d.es.
In these terms it is referred to as “Voxel”.
2. Scope and acceptance
These terms apply to Obliquo Reality Desktop licenses bought from within the application. Payment is made on a secure Stripe page that the application opens in the browser.
To complete the payment, the customer must tick the box “I accept the terms of sale and declare that I am buying as a business or professional”. The terms that apply are those published on this page at the time of purchase. After payment, Voxel sends an email with the license code and a link to these terms.
Businesses and professionals only. Obliquo Reality Desktop is sold only to businesses and professionals, for their business or professional activity; it is not sold to consumers. At purchase, the customer must give the tax ID (NIF) of the business or professional or, outside Spain, its VAT or tax identification number.
Licenses that Voxel issues through other channels, for example under an accepted quote, are governed by what was agreed in each case.
3. The product and the plans
Obliquo Reality Desktop is a Windows program for viewing, measuring and processing point clouds, panoramas and 3D models. It is installed and runs on the customer’s computer.
| Plan | What it includes | Price |
|---|---|---|
| Free | The viewer with the basic tools and a limit on points per cloud, shown in the application | €0 |
| Trial | All features for 14 days, once per computer | €0 |
| Basic | Conversion with no point limit; several files in one project; angle, area, profile, volume, Volume calculation and Section; overlay of cloud and panorama; creating and exporting annotations; export to LAS/LAZ; export of panoramas to Obliquo Cloud | €299.99 per year + VAT |
| Professional | Everything in Basic, plus: 3D models; DXF drawings and vector layers; Gaussian Splatting; navigation with collisions; voxel view; interferences and cross sections along a route; section vectorization; cable digitizing; georeferencing with control points; comparing and aligning clouds; surveying tools; descriptors; noise and people removal; classification; MCP server | €499.99 per year + VAT |
Before payment, the application shows the features of each plan. That list is part of the offer.
Minimum requirements:
- 64-bit Windows 10 or 11.
- 64-bit processor with 4 cores.
- 8 GB of RAM (16 GB recommended for large point clouds).
- Graphics card compatible with WebGL 2. A recent integrated one is enough; a dedicated one is recommended for large clouds and Gaussian Splatting.
- 1 GB of free disk space for the program, plus the space taken by projects.
- Internet connection to activate and revalidate the license (section 5).
We recommend using the free trial to check that the program runs well on the computer before buying.
4. Prices, taxes and payment
Prices are in euros and exclude VAT. The payment page calculates VAT from the billing address and the customer’s tax ID or VAT number, and shows the total before payment. Businesses in other EU countries must have a VAT number valid in VIES.
| Customer | VAT |
|---|---|
| Business or professional in Spain | 21 % |
| Business or professional in another EU country with a VAT number valid in VIES | No Spanish VAT: not subject to VAT under the place-of-supply rules |
| Business or professional outside the EU | No Spanish VAT: not subject to VAT under the place-of-supply rules |
Payment method. Payment is made by card or by the other methods shown on the payment page, such as Apple Pay, Google Pay, Link or Klarna. Payments are processed by Stripe; Voxel neither sees nor stores card details.
Promotion codes. A promotion code, if any, is entered on the payment page. Each code has its own conditions (discount, duration and validity).
Invoice. Voxel issues an invoice for each charge, with the name, tax ID and address given on the payment page, and emails it to the address given at payment. If there is a refund, it issues the corrective invoice.
Price changes. Voxel may change renewal prices. If it does, it notifies the customer by email at least 30 days before the renewal, and the customer may cancel the subscription before that date at no cost.
5. Delivery and activation of the license
The license is delivered as soon as payment is completed. The application activates it automatically on the computer it was bought from, and Voxel emails the license code (it starts with VOXL-). Keep this code: it is needed to move the license to another computer.
- One computer at a time. Each license can be used on only one computer at the same time. To change computers, deactivate it on the first one from the licenses window and activate it on the new one with the code.
- Internet connection. The application connects when the license is activated and then every 24 hours to revalidate it. Without a connection it keeps working for up to 7 days; after that it asks to connect.
- Offline computers. For computers that cannot connect to the internet, Voxel can provide an offline activation on request.
6. Term, renewal and cancellation
The license is an annual subscription that starts on the day of payment and renews automatically each year for another year. The renewal is charged to the same payment method, at the price then in force.
- Notice. Voxel sends an email 30 days before each renewal.
- Cancelling. The subscription can be cancelled at any time from the application, under Manage subscription. The license keeps working until the end of the paid period and is not renewed. Before that date, the cancellation can be undone from the same place.
- No refund for the current period. Cancelling does not entitle the customer to a refund of the unused part of the paid year, except as provided in section 10.
- Grace margin. The license stays active for 7 days after the end of the paid period, so that the renewal can complete without interruption.
- When it ends. The application returns to the Free plan. Projects saved on the computer are not deleted, but the paid features are locked.
7. Plan changes
The plan is changed from the application. The renewal date does not change.
- Upgrading from Basic to Professional. Takes effect immediately, and the price difference is charged for the time left until the renewal. For example, with 122 days left: (499.99 − 299.99) × 122 / 365 ≈ €66.85 + VAT. The license becomes Professional as soon as the charge succeeds.
- Downgrading from Professional to Basic. Takes effect at the next renewal, which is charged at the Basic price. Until then the license stays Professional, with no refund or credit. The change can be undone before the renewal.
8. Failed payments
If a renewal cannot be charged, Voxel notifies the customer by email with a link to update the payment method, and retries the charge for up to 3 weeks.
- If the bank asks for the payment to be confirmed (for example, with 3D Secure), the email includes a link to do so.
- If the charge still has not succeeded at the end of that period, the subscription is cancelled and the license expires as described in section 6.
- If the charge for a plan upgrade fails, the license stays on its current plan.
9. No right of withdrawal
Licenses are sold only to businesses and professionals (section 2), who have no right of withdrawal. The license is activated as soon as payment is completed, and the amount paid is not refunded except as provided in section 10.
The program can be tried for free for 14 days before buying (section 3).
10. Conformity, updates and support
Voxel is responsible for the program working as described in section 3 throughout the subscription. If it does not, the customer may ask for it to be fixed. If it is not fixed within a reasonable time, the customer may ask for a price reduction or terminate the contract and recover the proportional part paid.
- Updates. During the subscription, the customer receives the new versions Voxel publishes at no extra cost. Voxel may improve the program and change how its tools work. If a change removes a feature of the contracted plan during the paid period, Voxel gives advance notice and the customer may terminate the contract and recover the proportional part.
- Support. By email at info@voxel3d.es, Monday to Friday (working days), from 9:00 to 14:00 Spanish mainland time. Voxel replies within 2 working days at most.
11. Use of the license
The purchase grants a non-exclusive, non-transferable license to install and use Obliquo Reality Desktop on one computer at a time for the duration of the subscription. The program is not sold: it remains the property of Voxel. Third-party components included in it keep their own licenses, which can be viewed in the application.
The customer may not:
- share the license code or use it on more than one computer at a time;
- circumvent or tamper with the licensing system;
- decompile or disassemble the program, except where the law allows it;
- resell, rent or assign the license to third parties without Voxel’s authorization.
In the event of a serious breach of these rules, or if a payment is reversed without good reason, Voxel may suspend or revoke the license, giving notice beforehand where possible.
12. Liability
Obliquo Reality Desktop is a support tool. The customer must check measurements and results before relying on them for technical, design or construction decisions, and must keep backups of their data.
Voxel’s liability is limited to the amount paid for the license in the 12 months before the event giving rise to it. Voxel is not liable for loss of profits, loss of data or indirect damages, except in cases of wilful misconduct or gross negligence.
13. Personal data
Voxel processes the data needed for the purchase as data controller, in order to perform the contract and meet its legal and tax obligations.
- What data. Name or company name, email address, billing address and tax ID. Also the data of the license and of the computer it is activated on: an encrypted identifier of the computer, its name, the operating system and the program version.
- Who else is involved. Stripe, for payment and tax calculation; Holded, for invoices; and Amazon Web Services, in the European Union (Ireland), for the license server and for sending emails.
- What is not collected. Projects, point clouds and other files are processed on the customer’s computer. Voxel does not access them.
Further details, retention periods and how to exercise the rights of access, rectification, erasure and the other rights are in the privacy policy: https://grupocfi.es/privacidad/voxel3d/ (in Spanish).
14. Customer service and complaints
Questions, incidents and complaints are handled at info@voxel3d.es, on +34 983 02 41 78, or by letter to the address in section 1. Voxel answers complaints as quickly as possible and within one month at the latest.
15. Changes to these terms, governing law and courts
Voxel may update these terms. The new version applies to purchases made after it is published. For subscriptions already running, it applies from the next renewal: Voxel gives notice by email at least 30 days in advance, and the customer may cancel the subscription before that date at no cost.
These terms are governed by Spanish law.
For any dispute, both parties submit to the courts of Valladolid (Spain).
